These Terms of Service (the "Terms") govern access to and use of the website hosting, infrastructure, and software-as-a-service products (collectively, the "Services") provided by WebCore ("WebCore," "we," "us," or "our") to the individual or entity that subscribes to the Services ("Customer" or "you"). By creating an account, purchasing a subscription, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- "Subscription Plan" means the BASIC, PRO, or ENTERPRISE service tier selected by the Customer, as described in Section 5.
- "Monthly Uptime Percentage" means total minutes in a calendar month, minus minutes of Downtime, divided by total minutes in that month, expressed as a percentage. Excluded Downtime (Section 4) is not counted.
- "Downtime" means a period in which the Customer's production environment is wholly unavailable, as measured by WebCore's monitoring systems.
- "Scheduled Maintenance Window" means a recurring, pre-announced period during which WebCore performs security patching, upgrades, and maintenance, as described in Section 3.
2. Accounts, Subscriptions & Billing
Subscriptions are billed in advance on a monthly or annual basis according to the plan selected at checkout and renew automatically until cancelled. Fees are non-refundable except where these Terms or applicable law expressly require otherwise. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. WebCore may suspend or terminate accounts for non-payment, breach of these Terms, or use that threatens the security or integrity of the Services.
3. Scheduled Maintenance & Security Patch Windows
To keep the Services secure and current, WebCore performs maintenance and applies security patches during recurring Scheduled Maintenance Windows. WebCore reserves the right to take the Services offline during these windows. Time spent within a properly announced Scheduled Maintenance Window, and time spent applying Emergency Security Patches under the conditions below, is Excluded Downtime and does not count against the Monthly Uptime Percentage.
3.1 Standard Monthly Window
WebCore schedules one recurring maintenance window each calendar month, performed during off-peak hours (default: the first Sunday of each month, 00:00–06:00 UTC). The duration actually used and the amount of advance notice provided depend on the Customer's Subscription Plan, as set out in Section 5. WebCore will use commercially reasonable efforts to minimize the duration of, and any disruption caused by, each window.
3.2 Emergency Security Patches
Where a vulnerability, active exploit, or vendor advisory requires action before the next Standard Monthly Window, WebCore may apply Emergency Security Patches outside the scheduled window. WebCore will provide as much advance notice as is reasonably practicable under the circumstances and will limit the scope and duration of any resulting interruption. Emergency patching undertaken in good faith to protect the security of the Services is Excluded Downtime.
3.3 Notice
Notice of maintenance is published on the WebCore status page (
status.webcore.ws
) and, for PRO and ENTERPRISE plans, sent by email to the Customer's designated administrators within the notice periods stated in Section 5.
4. Service Level Commitment
For each calendar month, WebCore commits to the Monthly Uptime Percentage associated with the Customer's Subscription Plan (the "Service Level"). The following are excluded when calculating Downtime and the Monthly Uptime Percentage: (a) Scheduled Maintenance Windows; (b) Emergency Security Patches under Section 3.2; (c) outages caused by factors outside WebCore's reasonable control, including force majeure events and failures of third-party networks or providers; (d) outages resulting from Customer equipment, software, configuration, or content; and (e) suspension or termination of the Customer's account in accordance with these Terms.
5. Subscription Plans & Service Levels
The table below summarizes the standard service levels for each plan. Maximum allowable Downtime is shown for a 30-day month and excludes Scheduled Maintenance Windows.

6. Service Level Remedies
The Monthly Uptime Percentages in Section 5 are performance targets and commitments. WebCore does not offer service credits, refunds, or other financial compensation for any failure to meet a Service Level on any plan, including BASIC, PRO, and ENTERPRISE.
If WebCore fails to meet the applicable Service Level in a calendar month, WebCore's sole obligation, and the Customer's sole and exclusive remedy, is for WebCore to use commercially reasonable efforts to identify and correct the cause of the Downtime and to restore the Services. The Customer may report a suspected Service Level failure to

within thirty (30) days after the end of the affected month, including the dates and times of the Downtime; WebCore will investigate and, for ENTERPRISE plans, provide a written post-incident summary.
Nothing in this section limits the Customer's right to terminate under Section 10 or any remedy that cannot be excluded under applicable law.
6.1 Support Channels & Hours

For BASIC and PRO plans, support is provided during WebCore's standard business hours (Monday–Friday, 09:00–17:00 UTC, excluding public holidays), with a target first response within 48 business hours. ENTERPRISE plans receive 24/7 support with the response targets stated in Section 5. Response targets measure time to first human response, not time to resolution.
7. Acceptable Use
You may not use the Services to host or transmit unlawful, infringing, or malicious content; to send unsolicited bulk email; to attempt to gain unauthorized access to any system; or in any way that degrades the Services for other customers. WebCore may suspend Services that violate this section, with notice where practicable, to protect the Services and other customers.
8. Security, Data & Backups
WebCore maintains commercially reasonable administrative, technical, and physical safeguards designed to protect Customer data, including the regular security patching described in Section 3. The Customer remains responsible for the content it stores and for maintaining its own backups unless a managed backup option is included in its plan. WebCore processes personal data in accordance with its Privacy Policy.
9. Disclaimers & Limitation of Liability
Except for the express commitments in these Terms, the Services are provided "as is" and "as available," and WebCore disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose. To the maximum extent permitted by law, WebCore's aggregate liability arising out of or relating to the Services will not exceed the fees paid by the Customer for the affected Service in the twelve (12) months preceding the claim, and WebCore will not be liable for indirect, incidental, special, or consequential damages, including lost profits or data.
10. Term, Termination & Changes
These Terms remain in effect while the Customer uses the Services. Either party may terminate a subscription at the end of the then-current billing period. WebCore may update these Terms from time to time; material changes will be notified by email or via the status page at least thirty (30) days before they take effect, and continued use of the Services after that date constitutes acceptance.
